The world would be a very different place (I don't know if better or worse) if major league sports teams were forbidden from asserting trademark (and other intellectual property claims) on their brand. The legislative argument would be, in return for their legal exemption from anti-trust (legally protected monopoly), teams must contribute something back to society.
Let that "something" be a "national pastime"; that is, some aspects (IP) of the sport are "owned" by the nation, the public. Anyone can buy, or print, say clothing of their favorite team just as easily (and at market cost of the materials, not monopoly pricing for licensing) as American flag themed clothing.
