Can a state execute a pen register subpoena of the phone calls of the defense attorney of someone the state is prosecuting? Does the argument apply: the content of the call is privileged communication, but the metadata of who was contacted is not?
Surely this has been tried. If it legally failed, why?
To protect our privacy from the NSA, I think we need to expand the definition of privileged communication to include online cloud services like Gmail.
